Right to Information

About the Right to Information Act, 2005

The Right to Information Act, 2005 (RTI Act) is a central legislation that empowers every citizen of India to request information from public authorities. The Act mandates that public bodies maintain records properly and provide information requested by citizens within statutory timeframes.

The objective of the RTI Act is to promote transparency and accountability in the functioning of every public authority, reduce corruption, and ensure citizens can exercise informed democratic participation.

Key provisions:

  • Every citizen has the right to information under Section 3
  • Public Information Officer (PIO) must respond within 30 days of receiving an application (Section 7)
  • For matters involving life or liberty, response is required within 48 hours
  • First Appeal must be filed within 30 days of receiving the PIO's response (or the 30-day deadline passing)
  • Second Appeal / Complaint to the State or Central Information Commission must be filed within 90 days of the First Appellate Authority's decision

RTI Applicability to ADTC Firozabad

ADTC Firozabad is an Accredited Driving Training Centre operating under the Central Motor Vehicles Rules 1989 — a central legislation administered by the Ministry of Road Transport and Highways (MoRTH). As an accredited body conducting a government-recognized function (driver testing and Form 5B issuance), ADTC Firozabad is accountable to both:

How to File an RTI Application

Option A — Online (Recommended)

The Government of India provides a centralized online RTI portal for filing applications to all central government ministries and departments:

Option B — By Post / In Person

You may submit a written RTI application by post or in person. The application must:

  • Be addressed to the PIO of the relevant authority (ADTC, UP Transport Dept., or MoRTH)
  • State clearly: "I am requesting information under the Right to Information Act, 2005"
  • Specify the exact information being sought (as clearly and specifically as possible)
  • Include your full name, address, and contact details
  • Be accompanied by the prescribed fee (see Fee section below)

Identify the correct PIO

Determine whether your query is for ADTC centre records, UP Transport Dept. (accreditation/compliance), or MoRTH (national CMVR standards).

Draft your application

Clearly state each piece of information you seek. Vague or broad requests may be rejected. One application can contain multiple specific questions.

Pay the fee

Rs. 10 for the RTI application fee. Payment modes accepted by RTI Online portal: debit card, credit card, net banking, UPI.

Submit and receive acknowledgement

You receive an acknowledgement with a registration number. Track your application status on the RTI portal.

Receive response within 30 days

The PIO must respond within 30 days. If denied or partially denied, reasons must be given in writing.

File First Appeal if needed

If unsatisfied, appeal to the First Appellate Authority within 30 days of receiving (or not receiving) the PIO's response.

Note: Fees are as prescribed under the Right to Information (Regulation of Fee and Cost) Rules, 2005. UP State RTI may have separate fee rules for state-level RTIs — confirm at the time of filing.

What Information Can be Requested?

Under the RTI Act, you may seek:

  • Records, documents, memos, emails, opinions, advices, press releases, circulars, orders, log books, contracts, reports, papers, samples, models, data material
  • ADTC accreditation status and date of accreditation renewal
  • Compliance and inspection reports filed by UP Transport Department for ADTC Firozabad
  • Number of Form 5B certificates issued in a given period (aggregate data, not individual records of others)
  • Your own training records, evaluation scores, and Form 5B status
  • Details of any penalty or action taken against the centre
  • Budget or expenditure information (if publicly funded)

Exempt Information

The following categories of information are exempt from disclosure under Section 8 of the RTI Act and cannot be requested:

  • Personal information of other candidates (their evaluation scores, contact details, training records) — disclosure would violate individual privacy
  • Information that would endanger the safety of any individual
  • Commercial confidence or trade secrets (e.g., proprietary technology specifications of the ADTT system)
  • Cabinet papers and deliberative process records still in consideration
  • Information received in confidence from a foreign government

First Appeal and Second Appeal

First Appeal

If the PIO fails to respond within 30 days, provides incomplete information, or denies your request, you may file a First Appeal to the First Appellate Authority (an officer senior to the PIO, within the same public authority) within 30 days of the PIO's response or the expiry of the 30-day deadline.

Second Appeal / Complaint

If dissatisfied with the First Appeal outcome, you may file a Second Appeal or Complaint with:

  • Central Information Commission (CIC) — for central ministry PIOs (MoRTH): cic.gov.in
  • Uttar Pradesh State Information Commission (UPSIC) — for state-level PIOs (UP Transport Dept.): information.up.gov.in

Second appeals must be filed within 90 days of the First Appellate Authority's decision or the expiry of its 30-day response period.

Suo Motu Disclosure

Under Section 4(1)(b) of the RTI Act, public authorities are required to proactively disclose certain information without citizens having to request it. ADTC Firozabad and the UP Transport Department maintain the following categories of proactive disclosures publicly available:

  • Applicable fee structure for training programmes (subject to periodic revision)
